These Terms and Conditions govern the use of the website operated by Żgħażagħ Azzjoni Kattolika (ŻAK), including the creation and use of website accounts, membership registration and renewal, event registration, online payments, and other services made available through the website.

Please read these Terms carefully before using the website, registering as a member, or making a payment.

By using the website, you agree to comply with the provisions applicable to website use. Where you create an account, apply for membership, register for an event, or make a payment, you will also be required to accept the applicable Terms as part of that process.

Nothing in these Terms excludes or restricts any rights or protections which cannot lawfully be excluded under Maltese or European Union law.

Żgħażagħ Azzjoni Kattolika is a voluntary organisation operating in Malta.

References in these Terms to “ŻAK”, “we”, “us” or “our” refer to Żgħażagħ Azzjoni Kattolika.

References to “you” or “your” refer to the person using the website and, where applicable, a parent or legal guardian acting on behalf of a minor.

2. Scope of these Terms

These Terms apply to:

  • use of the ŻAK website;

  • creation and use of website accounts;

  • applications for ŻAK membership;

  • membership renewals and membership-related payments;

  • registrations and payments for ŻAK events and activities;

  • access to member-only areas and functionality; and

  • other online services made available by ŻAK.

Certain pages, registrations or events may contain additional information, including prices, deadlines, eligibility requirements and cancellation or refund conditions. That information forms part of the relevant registration or transaction.

3. Relationship with the ŻAK Statute

Membership of Żgħażagħ Azzjoni Kattolika is governed primarily by the Statute of Żgħażagħ Azzjoni Kattolika, together with applicable organisational policies and rules.

These Terms regulate the website and the administrative and transactional facilities provided through it. They do not replace the ŻAK Statute.

Where there is a conflict between these Terms and the ŻAK Statute concerning the nature, eligibility, governance, suspension, cessation or other organisational consequences of membership, the ŻAK Statute shall take precedence.

4. Use of the Website

You may use the website only for lawful purposes.

You must not:

  • attempt to gain unauthorised access to the website, another user’s account, or ŻAK systems;

  • interfere with the proper functioning or security of the website;

  • introduce malware, malicious code or other harmful material;

  • impersonate another person;

  • provide deliberately false or misleading information;

  • use information obtained through member-only areas for unauthorised purposes;

  • collect, scrape or systematically extract information about members or other users without authorisation;

  • use the website to harass, threaten or harm another person; or

  • use the website in a manner which infringes applicable law or the rights of another person.

ŻAK may take reasonable measures to protect the security, integrity and lawful use of the website.

5. Website Accounts

Certain features of the website require a registered account.

When creating or maintaining an account, you agree to:

  • provide information which is accurate and complete to the best of your knowledge;

  • keep your information reasonably up to date;

  • use your own account rather than another person’s account;

  • keep your login credentials confidential;

  • take reasonable steps to prevent unauthorised access to your account; and

  • notify ŻAK where you reasonably believe that your account has been compromised.

You are responsible for activity carried out through your account where that activity results from your failure to take reasonable measures to protect your login credentials.

You must not knowingly provide another person with access to restricted information which they are not authorised to access.

6. Minimum Age and Minors

The minimum age for creating a ŻAK website account and applying for membership through the website is 10 years.

Where a person is under 18 years of age, the involvement and consent of their parent or legal guardian is required as part of the registration process.

A parent or legal guardian providing information or consent on behalf of a minor confirms, to the best of their knowledge, that:

  • they have the authority to act on behalf of the minor;

  • the information provided is accurate; and

  • they have reviewed the information relevant to the registration.

Additional parental or guardian authorisation may be required for particular events, activities, travel, medical information, safeguarding requirements or similar matters.

Nothing in these Terms makes a parent or guardian automatically liable for every act or omission of a minor.

7. Applying for Membership

Submitting a membership application does not automatically create ŻAK membership.

Membership applications are reviewed and approved manually by ŻAK.

Payment of a membership fee, where payment is requested as part of the application process, does not by itself guarantee acceptance as a member.

Eligibility for membership and acceptance into ŻAK remain subject to the ŻAK Statute and applicable organisational procedures.

Where a membership payment is collected before an application is approved and ŻAK ultimately does not accept the application, any amount collected specifically as the membership fee will be returned, unless another lawful arrangement was clearly communicated before payment.

8. Membership Period

Unless otherwise stated, an approved membership is valid for a period of one year.

The applicable membership period, renewal date and membership status may be displayed within the member’s account.

Membership remains subject throughout that period to the ŻAK Statute and applicable organisational rules and policies.

9. Membership Fees

The applicable membership fee will be displayed before payment is requested.

Membership fees are generally non-refundable once membership has been approved, including where a member later voluntarily leaves ŻAK before the end of their membership period.

This does not affect:

  • any refund expressly offered by ŻAK;

  • any refund due because ŻAK did not approve an application for which payment had already been collected; or

  • any right to a refund, withdrawal or other remedy which ŻAK is required to provide under applicable law.

10. Automatic Membership Renewal

Unless otherwise stated during registration, membership is set to renew automatically each year using the payment method associated with the membership.

ŻAK will aim to send a renewal reminder approximately one month before the scheduled renewal date.

The reminder should include or provide access to the relevant renewal information, including the upcoming renewal date and applicable membership fee.

A member, or the parent or legal guardian responsible for the membership where appropriate, may disable automatic renewal at any time before the next renewal payment is processed.

Disabling automatic renewal does not cancel or shorten a membership period which has already been paid for. The membership will remain active until its existing expiry date, subject to the ŻAK Statute.

11. Failed Membership Renewals

If an automatic renewal payment cannot be successfully processed by the renewal date, the membership will expire on that date unless ŻAK confirms otherwise.

ŻAK may notify the member or responsible parent or guardian of the failed payment and may provide an opportunity to renew the membership manually.

ŻAK is not responsible for renewal failure caused by expired payment details, insufficient funds, payment-provider refusal or other circumstances outside ŻAK’s reasonable control.

12. Ending or Suspending Membership

The rules governing resignation, suspension, termination or other cessation of membership are governed primarily by the ŻAK Statute and applicable organisational policies.

Disabling a website account does not, by itself, determine a person’s membership status unless this follows from the Statute or an authorised decision of ŻAK.

Similarly, cancellation of automatic renewal does not constitute immediate resignation from an existing paid membership. It prevents the membership from renewing automatically after the current membership period expires.

13. Events and Activities

ŻAK may make events and activities available for registration through the website.

Events may be available to:

  • ŻAK members;

  • non-members; or

  • particular age groups, centres, groups or other categories of participants.

Eligibility requirements will be communicated where relevant.

Submitting an event registration does not necessarily guarantee participation where the event requires approval, has limited capacity, requires payment, or is otherwise subject to additional conditions.

14. Event Prices and Payment

Where an event requires payment, the applicable price will be displayed before the registration is completed.

Any material additional charges known to ŻAK will also be communicated before payment.

A booking will be considered confirmed once any required registration steps and payment requirements have been completed and, where applicable, ŻAK has accepted the registration.

Users should check the information entered before submitting an event registration or payment.

15. Event Cancellation and Refunds

Cancellation and refund conditions may vary between events.

The applicable cancellation and refund policy for a paid event will therefore be communicated as part of the event information or registration process before payment is completed.

By completing the booking, you agree to the cancellation and refund conditions communicated for that event.

Where no participant cancellation right exists because of the nature or date of an event, this will be communicated where required.

Nothing in an event cancellation policy removes any mandatory rights available under applicable law.

16. Personal Nature of Event Bookings

Event registrations are tied to the individual named in the registration.

A booking may not normally be sold, assigned or transferred to another person.

ŻAK may, at its discretion, permit a correction or transfer in exceptional circumstances where this is appropriate and does not conflict with eligibility, safeguarding, insurance, capacity or other event requirements.

17. Changes, Postponements and Cancellation of Events by ŻAK

ŻAK may occasionally need to modify, postpone or cancel an event due to circumstances including:

  • safety or safeguarding concerns;

  • insufficient participation;

  • illness or unavailability of essential organisers;

  • venue unavailability;

  • severe weather;

  • transport disruption;

  • instructions from public authorities;

  • emergencies; or

  • other circumstances outside ŻAK’s reasonable control.

Where a material change occurs, ŻAK will make reasonable efforts to inform registered participants using the contact information available to it.

Where ŻAK cancels a paid event, the applicable refund or alternative arrangements will be communicated to affected participants, taking into account the circumstances of the cancellation and applicable law.

18. Conduct, Safety and Safeguarding

Participants in ŻAK activities are expected to behave in a manner consistent with:

  • the ŻAK Statute;

  • applicable safeguarding requirements;

  • codes of conduct or ethics adopted by ŻAK;

  • reasonable instructions from authorised ŻAK leaders or representatives;

  • health and safety requirements; and

  • applicable law.

ŻAK may take reasonable and proportionate action where conduct creates a safeguarding, safety, security or serious behavioural concern.

This may include restricting participation in an activity or access to website functionality where necessary.

Any effect on ŻAK membership itself remains subject to the ŻAK Statute and applicable organisational procedures.

19. Payments and Stripe

Online payments may be processed using Stripe or another payment provider identified during the payment process.

Payment processing is subject to the technical and contractual arrangements of the relevant payment provider.

ŻAK does not intend to directly store full payment-card details where those details are processed securely by the payment provider.

Where payment cannot be completed, the relevant membership renewal, event registration or other transaction may remain incomplete.

The use of third-party payment providers may also involve the processing of personal data in accordance with the ŻAK Privacy Policy and the privacy practices of the relevant provider.

20. Member Profiles and Restricted Information

Certain information and functionality may be available only to authorised logged-in users.

Access may depend on a user’s role within ŻAK.

Users must not attempt to access information which has not been made available to their account or role.

Information obtained from restricted member areas must only be used for legitimate ŻAK purposes and in accordance with applicable ŻAK policies and data-protection requirements.

The fact that information can be viewed through a logged-in area does not make that information public.

21. Personal Data

ŻAK processes personal data in connection with website accounts, memberships, events and other activities.

This may include information supplied during registration, including a passport-style photograph where required for membership administration.

Detailed information about:

  • the categories of personal data collected;

  • the purposes and legal bases for processing;

  • access to member information;

  • recipients and service providers;

  • retention periods;

  • international transfers where applicable;

  • data-subject rights; and

  • how to exercise those rights

22. Photographs and Media at Activities

Some ŻAK activities may involve photography, video recording or other media.

Where appropriate, information concerning such processing and any applicable consent arrangements will be provided separately in accordance with the ŻAK Privacy Policy and relevant safeguarding procedures.

Attendance at an event does not, by itself, constitute unlimited consent for ŻAK to use an individual’s image for any purpose.

23. Cookies and Similar Technologies

The website may use cookies and similar technologies for purposes including essential website functionality, security, preferences, analytics or other permitted purposes.

Where consent is legally required for a particular category of cookie or similar technology, ŻAK will request that consent through the website’s cookie management system.

25. Intellectual Property

Unless otherwise indicated, the website and original content produced by ŻAK, including text, graphics, photographs, logos, designs and other material, are owned by or licensed to Żgħażagħ Azzjoni Kattolika and are protected by applicable intellectual-property laws.

You may access and use website content for personal, informational and legitimate ŻAK-related purposes.

You must not reproduce, commercially exploit, materially modify or redistribute protected ŻAK material without permission where such permission is required by law.

Nothing in these Terms claims ownership over material belonging to third parties.

Any third-party trademarks, photographs, logos or other intellectual property remain the property of their respective owners.

26. User-Provided Material

Where you provide photographs, documents, information or other material through the website, you confirm that you are entitled to provide that material for the relevant purpose.

Providing material to ŻAK does not transfer ownership of that material to ŻAK unless expressly agreed.

ŻAK may use material submitted through registration or other website facilities only to the extent reasonably necessary for the purpose for which it was provided, another lawful purpose described in the Privacy Policy, or as otherwise permitted by law.

27. Website Availability

ŻAK aims to keep the website and its online services available and functioning correctly but cannot guarantee uninterrupted or error-free operation.

Access may occasionally be unavailable because of:

  • maintenance;

  • technical faults;

  • security measures;

  • hosting or third-party service failures;

  • upgrades; or

  • circumstances outside ŻAK’s reasonable control.

ŻAK may modify, replace or discontinue website features where reasonably necessary.

Where a change materially affects an existing paid service or contractual entitlement, ŻAK will respect any rights which cannot lawfully be excluded.

28. Account Restrictions and Suspension

ŻAK may temporarily restrict or suspend access to an account where reasonably necessary because of:

  • suspected unauthorised access;

  • security concerns;

  • suspected fraud;

  • serious misuse of the website;

  • safeguarding concerns;

  • a serious breach of these Terms;

  • a requirement under law; or

  • a decision properly taken under the ŻAK Statute or applicable organisational policies.

Where appropriate and lawful, ŻAK will endeavour to explain the reason for a material restriction.

Restriction of website access does not remove any rights or obligations which cannot lawfully be affected by such restriction.

29. Liability

ŻAK will exercise reasonable care in operating the website and providing services made available through it.

However, ŻAK cannot guarantee that:

  • the website will always be available;

  • all website content will always be free of errors;

  • third-party services will always operate correctly; or

  • circumstances outside ŻAK’s reasonable control will not affect an activity or service.

To the extent permitted by law, ŻAK will not be responsible for losses caused solely by circumstances which it could not reasonably have prevented.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

Nothing in these Terms affects any mandatory statutory rights available to you.

30. Circumstances Outside ŻAK’s Reasonable Control

ŻAK will not be treated as having breached these Terms where performance of an obligation is prevented or materially affected by circumstances outside its reasonable control.

Such circumstances may include natural disasters, severe weather, public emergencies, government action, widespread transport disruption, utility or communications failures, industrial action, venue closures or other comparable events.

Where such circumstances affect a paid event or service, ŻAK will communicate the available options to affected persons as soon as reasonably practicable.

31. Changes to these Terms

ŻAK may update these Terms from time to time to reflect:

  • changes to the website or its services;

  • organisational changes;

  • legal or regulatory requirements;

  • security requirements; or

  • improvements or clarifications.

The latest version will be published on the website together with the date on which it was last updated.

Minor or administrative changes may take effect when published.

Where a change materially affects an ongoing paid service, recurring membership arrangement or other substantive right or obligation, ŻAK will take reasonable steps to provide appropriate notice before the change takes effect where required or appropriate.

Changes to these Terms will not remove rights already acquired under applicable law.

32. Communications

Where you provide ŻAK with an email address or other contact information, ŻAK may use those details for legitimate communications relating to matters such as:

  • your account;

  • membership administration;

  • membership renewal;

  • event registrations;

  • payments;

  • safeguarding or safety matters;

  • important organisational information; or

  • requests you have submitted.

Marketing or promotional communications will be handled separately where consent or another legal basis is required.

You are responsible for keeping relevant contact information reasonably up to date.

33. Complaints and Enquiries

Nothing in this section prevents a person from exercising any right to contact a competent regulatory authority, consumer authority, court or other body where permitted by law.

34. Accessibility

ŻAK aims to make its website reasonably accessible to users.

ŻAK will make reasonable efforts to investigate and address accessibility issues within its control.

35. Severability

If any provision of these Terms is found by a competent authority or court to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the extent necessary where legally possible.

The remaining provisions will continue to apply.

36. No Waiver

If ŻAK does not immediately enforce a provision of these Terms, this does not automatically mean that ŻAK has waived that provision or its right to enforce it later.

Similarly, nothing in these Terms prevents a user from exercising a right available under applicable law.

37. Governing Law and Jurisdiction

These Terms are governed by the laws of Malta, subject to any mandatory rights or protections which apply under Maltese or European Union law.

Any dispute concerning these Terms shall be subject to the jurisdiction of the competent courts or tribunals of Malta, except where applicable law gives a consumer or other person a mandatory right to bring proceedings elsewhere.
